In films and TV, it is often a high point when one half of a married couple moves out of the matrimonial home.  In doing so, they will then have their “final say” to prove they were right all along.  The door then slams and the credits roll.

But whether they were right or wrong, the real question should be whether they made the right decision – about moving out or not.  That is really the most important question.  Because if you think that divorcing from your spouse is stressful, moving out can also mean you are divorcing yourself from your house as well, making yourself homeless as well is not a good idea.

Some people think that moving out is part of moving on with their life and they think this is somehow related.

But by moving out will it have a big say on how the matrimonial finances settle.

2. Do any Necessary Purchases or Sales now

When your matrimonial financial division case starts, the Court makes an order at the start of the case that stops you and your spouse from disposing of marital property – for example emptying a joint bank account or giving away marital property out of spite.  All of the matrimonial assets technically become in the ownership of the court and the court has the right to set these transactions aside.  Especially if something is sold at an undervalue out of bad feeling.

So is it a good idea to get that joint bank account drained early before your case starts?

3. Protecting your interest in your home

If your name not is on the title deeds of the place where you live, then you are at risk of losing your home.

This is because if your name is not on the title deeds then the person who is on the title deeds can, without your knowledge, sell the home without you knowing.

Or almost just as bad, could even take out a second mortgage on your home leaving the property saddled with huge debt without you knowing.  By the time you find out it may be too late.

4. Interim Maintenance. What is it and how to get it.

“Maintenance Pending Suit” is a strange definition.  But that is what the court calls it.  What it means is maintenance that is paid in the period between now and the final order of divorce.

5             Your Will and Your Divorce

Nobody likes to speak about death.  Especially when you are going through a divorce as well!

But if you are married and you die without a Will, your estate will automatically go to your spouse.

Even if you are married and have a Will, if you start your divorce does that change that Will?

What about if you died before that final divorce order is eventually is made by the Court?
